[HNA News] Special Permit requested at 300 Germantown Road

I emailed Carol Berz last week regarding the special permit request for 300
Germantown as a daycare. She asked Brian Shults about the permit. Below you
will find my original email to Carol Berz, a response from Brian, and
Carol's response. It seems that we need to show our concern for this type of
establishment in this area (they have indeed applied for a curb cut as well)
at the meeting on Wednesday, May 14th at 10:00am. This could mean an
entrance and exit on Germantown.
*My original email*
There is a house at the corner of Germantown and Lerch (300 Germantown) that
has asked for special zoning for a daycare. Do you know any of the rules
regarding businesses on Germantown past Navajo? Also, do you know if there
is any kind of precedent that would be set if the special zoning is
approved?
We are quite concerned due to the insane amount of traffic that is
already at this intersection, let alone if there was a day care facility
that requires parents to drop off and pick up their children. In addition to
the traffic, we are under the understanding that they have applied for some
kind of curb cut, as well. I honestly do not know what that means. Anyway, I
have no idea if you can help us, but would like to see what you know. We
appreciate help you could provide.

"The case on Germantown Road is a Special Exception Permit from the Board of
Appeals for a Pre-Kindergarten Learning Center. The property is currently
zoned R-1, and per the zoning ordinance Kindergartens not operated by a
governmental or religious organization are permitted subject to a special
permit by the Board of Appeals. I have attached a copy of the Board of
Appeals Application and a proposed site plan for the property. Per the site
plan, it appears that the applicant is proposing a curb-cut, which may be an
existing curb-cut off of Lerch Street. The Board of Appeals meeting is
Wednesday, May 14, 2008 at 10:00 a.m. I would encourage those to be in
attendance at the Board of Appeals so as to speak in opposition to or in
support of the proposed request. It has also been the policy at RPA to try
to hold the line of commercial and office expansion along S. Germantown Road
to no further than Navajo Road. I hope this information helps."

"Thanks Brian - I think that the residents have a good point. This is an
R-1 area and the exceptions have gone far enough. I think Navajo is a good
stopping point. As I will be out of town on the 14th, I will be sending a
lawyer from our office to argue that point."
